At 11:45 a.m. on February 11, police received calls regarding gun shots heard near the area of Grimes and W. 1st Avenue. Officers responded to the location and upon arrival, they contacted two individuals who reported someone was shooting in the area. Patrol and K-9 officers spotted a man standing in the window of a business holding a shotgun, approximately 20 feet from their location. The man began crouching down and backing away from the front glass door, in a furtive posture, holding the shotgun.
Officers took cover and initiated a phone call through dispatch into the location. After a short conversation, the man came out without the firearm and explained that he thought he had heard someone attempting to break in, stepped outside with his shotgun and told them to leave. He said an individual started walking toward him, so he fired two warning shots into the air. Daniel Y. Fung, age 40, of Eugene, was cited in lieu of custody for Unlawful Discharge of a Firearm.
